Il soutient que cette proc\u00e9dure le dispense de d\u00e9montrer qu\u2019il a exerc\u00e9 de vaines poursuites pr\u00e9alables contre la soci\u00e9t\u00e9.<\/p>\n<p>Argument rejet\u00e9 par la Cour de cassation : lorsqu\u2019une soci\u00e9t\u00e9 civile est plac\u00e9e en liquidation amiable, son cr\u00e9ancier ne peut agir contre les associ\u00e9s qu\u2019en d\u00e9montrant que le patrimoine social est insuffisant pour le d\u00e9sint\u00e9resser (sur le fondement de l\u2019article 1858 du Code civil).<\/p>\n<p><strong>\u00c0 noter<\/strong><\/p>\n<p>Confirmation de jurisprudence.<\/p>\n<p>La Haute Juridiction a d\u00e9j\u00e0 jug\u00e9 que, m\u00eame lorsqu\u2019une soci\u00e9t\u00e9 civile est dissoute, ses cr\u00e9anciers ne peuvent poursuivre les associes en paiement des dettes sociales qu\u2019apr\u00e8s avoir exerc\u00e9 de vaines poursuites contre la soci\u00e9t\u00e9 (Cass. 3<sup>e<\/sup>\u00a0civ. 3-7-1996n\u00b0\u00a094-11.215). De m\u00eame, dans le cas d\u2019un groupement agricole d\u2019exploitation en commun, auquel les dispositions des soci\u00e9t\u00e9s civiles sont applicables : C. rur. art. L 323-1), qui avait \u00e9t\u00e9 dissous par l\u2019arriv\u00e9e de son terme, il a \u00e9t\u00e9 jug\u00e9 que le cr\u00e9ancier du groupement ne pouvait agir contre les associ\u00e9s qu\u2019apr\u00e8s avoir pr\u00e9alablement et vainement poursuivi ce dernier (Cass. com. 30-9-2020 n\u00b0 18-26.044).<\/p>\n<p>Apr\u00e8s la cl\u00f4ture de la liquidation, en revanche, le cr\u00e9ancier est dispens\u00e9 d\u2019agir pr\u00e9alablement contre la soci\u00e9t\u00e9 : il peut directement se retourner contre les associ\u00e9s (Cass. 3<sup>e<\/sup>\u00a0civ. 10-2-2010 n\u00b0\u00a009-10.982\u00a0; Cass. com. 21-3-2018 n\u00b0 16-18.362).
